Agreement
These Terms & Conditions govern your use of the JoynerPain Protocol services. By enrolling in or using our services, you agree to these terms.
Nature of Services
The JoynerPain Protocol provides:
- Educational coaching about persistent pain and pain neuroscience
- Coaching support for developing pain self-management skills
- Guidance on behavioural strategies and stress management
- Accountability and encouragement for personal development
This is NOT:
- Medical treatment, diagnosis, or medical advice
- Physiotherapy, psychological therapy, or pain medicine
- A substitute for professional medical care
- A guarantee of specific outcomes or results
Eligibility
- To participate in the programme, you must:
- Be at least 18 years of age
- Obtain medical clearance from your GP or qualified medical practitioner
- Continue your ongoing medical care with qualified healthcare providers
- Take responsibility for your own health and wellbeing decisions
- Seek appropriate medical care when needed
Client Responsibilities
As a participant, you agree to:
- Engage honestly and openly in the coaching process
- Follow the programme requirements and structure
- Complete assigned work between sessions
- Take responsibility for your own health decisions and actions
- Report any new or concerning symptoms to your medical provider immediately
- Contact emergency services (e.g. 112/999) for medical emergencies
Programme Structure
- Duration: 8-12 weeks (flexible based on individual progress)
- Format: Online via video call
- Includes: Coaching sessions, educational materials, email support (as defined in your programme agreement)
Payment and Fees
Programme fees, payment terms, and cancellation policies are specified in your individual coaching agreement.
All fees are in Euros (€) unless otherwise specified.
Cancellation and Rescheduling
Session cancellation and rescheduling policies are specified in your coaching agreement.
Generally:
- Individual sessions may be rescheduled with appropriate notice
- Group sessions cannot be rescheduled due to logistical constraints
- Specific policies depend on programme type (individual vs. group)
Refund Policy
Refund policies are specified in your individual coaching agreement and vary based on:
- Programme type (individual vs. group)
- Payment structure (pro bono, full payment, or payment plan)
- Timing of withdrawal (before or after programme commencement)
No Guaranteed Outcomes
We make no representations, warranties, or guarantees about specific outcomes, results, or improvements.
Success depends on many factors including your personal effort, commitment, engagement, and individual circumstances.
Limitation of Liability
To the fullest extent permitted by law:
The Coach's maximum liability for any claim arising from this coaching relationship is limited to two times (2x) the fees paid by you for the programme.
The Coach is NOT liable for:
- Any indirect, consequential, special, or punitive damages
- Medical outcomes or complications
- Your decisions or actions taken during or after the programme
Nothing in these terms excludes liability for death or personal injury caused by gross negligence, fraud, or any liability that cannot be excluded by law.
Intellectual Property
All materials provided (educational content, documents, videos, resources) are the intellectual property of JoynerPain Protocol and are for your personal use only.
You may not copy, reproduce, distribute, sell, or share these materials without written permission.
Confidentiality
Session content and information you share are kept confidential, except where:
- You participate in a group programme
- You provide written consent to share
Required by law or legal process - There is serious risk of harm to you or others
- Necessary for professional supervision (with identifying information removed)
Professional Boundaries
The coaching relationship is professional in nature. Both parties agree to maintain appropriate professional boundaries and conduct all interactions respectfully.
Termination
Either party may terminate the coaching relationship as specified in your coaching agreement.
The Coach reserves the right to terminate immediately for:
- Non-payment of fees
- Failure to obtain medical clearance
- Behaviour that is disruptive, disrespectful, abusive, or threatening
- Medical symptoms requiring immediate medical attention
- Fundamental breach of these terms
Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of Ireland.
Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith discussion. If unsuccessful, mediation will be attempted before pursuing legal action.
Changes to Terms
We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on this page. Continued use of services after changes constitutes acceptance of the modified terms.
Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in full effect.
Entire Agreement
These Terms & Conditions, together with your individual coaching agreement, constitute the entire agreement between you and JoynerPain Protocol.
